Terms of service

These Terms of Service ("Terms") are a binding agreement between you and Enrique And Greatness Inc. ("Enrique & Greatness," "we," "us"). They govern your use of enriqueandgreatness.com, our digital products, courses, templates, coaching, calls, emails, and content (the "Services"). By using the Services or making a purchase, you agree to these Terms, our Privacy Policy, Refund Policy, and Disclaimers. If you do not agree, do not use the Services.

PLEASE READ SECTION 12 CAREFULLY. IT REQUIRES MOST DISPUTES TO BE RESOLVED BY INDIVIDUAL ARBITRATION AND WAIVES CLASS ACTIONS AND JURY TRIALS.

1. Eligibility

You must be at least 18 and able to form a binding contract. If you buy for a company, you confirm you can bind it to these Terms.

2. Educational services only

The Services are for general education and information only. Enrique & Greatness is not a mortgage lender, broker, school, or licensing authority, and the Services are not NMLS-approved pre-licensing or continuing education unless a product clearly says so. Nothing in the Services is legal, compliance, tax, financial, or mortgage advice, or an offer to lend or to hire. You are solely responsible for meeting all licensing, advertising, and compliance rules (including NMLS, CFPB, RESPA, TILA, state regulators, and your employer's policies) before using any material with the public. Enrique Flores's work as a licensed loan officer for any lender is separate from Enrique & Greatness, and that lender is not responsible for the Services.

3. No guarantees of results

We make no promise that you will get licensed, hired, close loans, or earn any amount of money. Your results depend on your own effort, skill, market conditions, and many other factors. See our Disclaimers.

4. Purchases and payment

Prices are in U.S. dollars and may change at any time. We may refuse or cancel any order, including for pricing errors or suspected fraud. You authorize us and our payment processors to charge your payment method for all purchases and any applicable taxes.

5. License to digital products

When you buy a product, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use it for your own business. You may customize templates for your own marketing to your own clients. You may not: resell, share, give away, post publicly, or distribute the products, files, or template links; share login access or downloads with anyone else (including coworkers or teams, unless you bought a team license); use the products to create competing training products; or remove our copyright notices. We may end your license and access, without refund, if you break these rules, and we may pursue all legal remedies.

6. Intellectual property

All content on the Site and in our products, including text, videos, presentations, templates, graphics, logos, and the names "Enrique & Greatness" and "Enrique And Greatness," is owned by or licensed to Enrique And Greatness Inc. and protected by copyright and trademark law. Except for the license above, no rights are granted to you.

7. Free calls, coaching, and events

Free Q&A calls, coaching, workshops, and webinars are educational conversations. They do not create a professional, advisory, employment, or fiduciary relationship. All calls are recorded, and by booking or joining a call you consent to being recorded as described in our Privacy Policy. We may reschedule or cancel calls at our discretion. Discussions about career opportunities are informal and are not an offer of employment; any hiring is handled separately by the relevant employer.

8. Your content and testimonials

If you submit reviews, testimonials, comments, questions, or other content, you grant us a worldwide, royalty-free, perpetual license to use, edit, and publish it, with your first name or initials, in any media, including marketing. You confirm your content is truthful and reflects your own experience, and that you have the right to share it. We may remove any content at our discretion.

9. Acceptable use

You agree not to: break any law; copy, scrape, or pirate content; upload malware; interfere with the Site; impersonate anyone; send spam; or use the Services to mislead consumers or violate lending or advertising laws.

10. Disclaimer of warranties

THE SERVICES AND ALL PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. Laws and industry rules change; we do not warrant that any content is current, complete, error-free, or compliant in your state or for your situation.

11. Limitation of liability

TO THE FULLEST EXTENT ALLOWED BY LAW, ENRIQUE AND GREATNESS INC., ITS OWNERS, OFFICERS, EMPLOYEES, AND CONTRACTORS (INCLUDING ENRIQUE FLORES PERSONALLY) WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, INCOME, BUSINESS, DATA, OR OPPORTUNITIES, OR FOR ANY REGULATORY FINES OR PENALTIES, ARISING FROM THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR $100. Some states do not allow these limits, so some may not apply to you.

12. Dispute resolution, arbitration, and class action waiver

Informal resolution first. Before filing any claim, you agree to email enriqueandgreatness@gmail.com with a description of the dispute and try to resolve it with us for at least 30 days.

Binding arbitration. Any dispute arising from these Terms or the Services will be resolved by final, binding, individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, before one arbitrator, in Los Angeles County, California, or by video. The Federal Arbitration Act governs this section. The arbitrator decides all issues, including whether a dispute must be arbitrated.

Exceptions. Either party may bring an individual claim in small claims court, and either party may seek a court order to stop infringement or misuse of intellectual property.

Class action and jury waiver. YOU AND WE EACH WAIVE THE RIGHT TO A JURY TRIAL AND TO BRING OR JOIN ANY CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION. Claims may be brought only on an individual basis. If a claim for public injunctive relief cannot be waived under applicable law, that claim will be severed and decided by a court after the arbitration ends.

30-day opt-out. You may opt out of arbitration by emailing us within 30 days of your first purchase or use, with "Arbitration Opt-Out" in the subject.

Time limit. To the extent allowed by law, any claim must be filed within one year after it arises, or it is permanently barred.

13. Indemnification

You will defend, indemnify, and hold harmless Enrique And Greatness Inc. and its owners, officers, employees, and contractors from any claims, losses, fines, and expenses (including attorneys' fees) arising from your use of the Services or our materials, your violation of these Terms or any law (including lending and advertising laws), or your dealings with your own clients.

14. Chargebacks

If you have a problem with a purchase, contact us first. Filing a chargeback without contacting us breaches these Terms. We may contest chargebacks and immediately end your access to all products.

15. Termination

We may suspend or end your access at any time if we believe you broke these Terms. Sections 5, 6, and 8 through 18 survive termination.

16. Third-party services

The Services may link to or use third-party tools (such as Shopify, Canva, Calendly, Zoom, YouTube, and Mailchimp). We are not responsible for them, and your use is subject to their terms.

17. Governing law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Subject to Section 12, the state and federal courts in Los Angeles County, California have exclusive jurisdiction.

18. General

If any part of these Terms is unenforceable, the rest remains in effect. Our failure to enforce a right is not a waiver. You may not assign these Terms; we may. We are not liable for delays caused by events beyond our control. These Terms, with the policies they reference, are the entire agreement between us. We may update these Terms at any time by posting the new version; continued use means you accept them.
